On June 12, 1823, in a letter to Supreme Court Justice William Johnson(December 27, 1771-August 4, 1834), regarding the meaning to the Constitution, Thomas Jefferson wrote:<On every question of construction, carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.> (Interpret the Constitution by Original Intent, it is not a living document but the Rule of Law)
On April 30, 1802, President Thomas Jefferson signed the enabling act for Ohio to become a state. It stated that the government in this new state “not be repugnant to the [Northwest] Ordinance”(passed unanimously in 1787): <The Northwest Ordinance-Article III. Religion, morality, and knowledge being necessary to good government and the happiness of mankind, schools and the means of education shall be forever encouraged.> (Jefferson was also superintendent of the Washington school district when they used the Bible and Watts Hymnal in their classrooms and even attended church services in the Capitol building)
Conclusions: In our form of government the law is supposed to come from the peoples branch the Congress, then go to the Senate, then the President signs it or vetoes. Laws are not supposed to be made in the Courts or by the President and especially not by bureaucracies like the EPA or FHA. The Courts are supposed to interpret and enforce the law equally not by partisan politics. Legal Positivism has also replaced the Natural Law view of the founder’s era, a big difference that “We the People” didn’t get to vote on.
Progressive in the beginning meant that we have evolved past the founding era where they seen government as a force that had to be kept in chains or it would become despotic to thinking we can use the government to make people’s lives better, that is to say we have progressed past the founding era. A lot of Christians agreed with the Progressive Movement at the turn of the 20th Century. Progressives decided changing the constitution and our law through the amendment process was too hard; they decided they would change them through the courts and did by using Legal Positivism.
Nine judges were never meant to rule America! They block a majority of 65% of Americans that want Intelligent design taught and 75% say they would not mind it, amazing, even after 60 plus years of brainwashing by a minority Secular orthodoxy. They do not want ID taught because because it strikes at the heart of their elitist philosophy. Intelligent Design is a rational and logical conclusion when we observe the order, complex design, fine tuning, insurmountable odds of random mutation and purpose in the world around us,
Fringe radical Intellectual movements of the past with Neo-Marxist Reductionism at its core like Critical Pedagogy, Post Modernism and Critical Theory became main stream and hijacked the Progressives, Secular Humanists, Pragmatists and Transcendentalism starting as early as the 1930s. These earlier philosophies were a lot friendlier to Western Culture, Free Markets and Religions, believing faith was part of mans psyche. A minority fringe is attacking traditional American creeds, values, traditions, history and especially Christian religion and history and changing America. They pretty much believe all social norms and western culture is oppressive, even male and female distinctions. ID challenges the core belief of Reductionism or that every thing is a result of random matter in motion and chemical reactions.
Thomas Jefferson’s warnings about the courts and George Washington’s warnings in his farewell address hit it right on the nose. Our founders were a lot wiser than these modern revisionist want to give them credit for.
The courts overriding a majority vote of the people makes our government an Oligarchy and Illegitimate and breaks the Social Contract Theory of Majority Rule. The elites think they know better than “WE THE PEOPLE”. It makes me mad and I want to yell in their faces “I see you TYRANTS, DESPOTS and HYPOCRITES” !!!
